These Terms of Service (“Terms”) govern your use of evergreenrainguttersllc.com and any interaction with Evergreen Rain Gutters LLC (“Evergreen,” “we,” “us”) through that website. By using the site, submitting an inquiry through the contact form, chatting with the website assistant, or otherwise engaging with Evergreen online, you agree to these Terms.
1. About Evergreen
Evergreen Rain Gutters LLC is a Washington State licensed, bonded, and insured contractor providing roofing, gutter, siding/soffit/fascia, and storm damage services to homeowners in Spokane, WA and within a 50-mile service radius. Evergreen has been in operation since 2023.
2. Free estimates and inquiries
When you contact us through the website (contact form, chat assistant, phone, or email), we’ll respond as quickly as possible — typically within one business day. Any estimate we provide is free, non-binding, and provided in good faith based on the information available at the time. A submitted inquiry does not create a contract for work; work begins only after a separate written agreement is signed by both parties.
Evergreen may decline to provide an estimate or service for any lawful reason, including projects outside our service area, scope, or licensure.
3. Project agreements (separate document)
Specific projects are governed by a separate written project agreement covering scope of work, pricing, materials, schedule, payment terms, change orders, and warranty. These website Terms do not govern paid work — only your use of this website and the inquiry process. If anything in these Terms conflicts with a signed project agreement, the project agreement controls.
4. Warranties
For projects we complete under a signed agreement, Evergreen provides:
- 10-year workmanship warranty on roofing
- 5-year workmanship warranty on gutters
- Manufacturer warranties on materials, per the manufacturer’s published terms
Warranty specifics, exclusions, and claim procedures are detailed in your signed project agreement and warranty document. Warranties cover Evergreen’s workmanship; they do not cover damage from storms, vandalism, neglect, modifications by other parties, or ordinary wear caused by extreme weather.
5. License and insurance
Evergreen is licensed by the State of Washington, fully bonded, and carries liability and workers’ compensation coverage. We are not currently licensed in Idaho; Idaho service is dependent on a license that is pending. Proof of license and insurance is available on request.
6. Use of the website
You agree to use this website lawfully and only for purposes related to a real interest in our services. You will not:
- Submit false, misleading, or impersonating information
- Attempt to disrupt, attack, scrape at scale, or reverse-engineer the site or its automation
- Use the site to send spam, harassment, or content that violates any law
- Copy, modify, or republish website content (including text, images, and design elements) without our written permission
All website content, including text, images, logos, layouts, and the chat assistant’s prompt and outputs, is owned by Evergreen or used with permission. The Evergreen name and logo are property of Evergreen Rain Gutters LLC.
7. Website chat assistant
Our website includes an AI-powered chat assistant that helps qualify inquiries and collect contact information. The assistant is provided to make it easier to start a conversation. It is not a substitute for a written estimate, a project agreement, or professional advice. It may make mistakes; any pricing, scheduling, or commitment must come from Evergreen in writing or by phone with the owner.
8. Communications — phone, SMS, email
When you provide your phone number or email, you authorize Evergreen to contact you through those channels regarding your inquiry or project. SMS-specific terms (consent, frequency, carrier rates, opt-out via STOP, help via HELP) are described in our Privacy Policy. You may opt out of any communication channel at any time.
9. Disclaimer of warranties (website only)
The website and the chat assistant are provided “as is.” Evergreen does not warrant that the website will be uninterrupted, error-free, or free of defects. We do not warrant the accuracy or completeness of any information presented through the website outside of a signed project agreement. This disclaimer applies to website content only and does not limit any warranties Evergreen provides for actual completed work.
10. Limitation of liability
To the maximum extent permitted by law, Evergreen’s liability arising out of or related to your use of the website (including the chat assistant) is limited to the amount you have paid Evergreen, if any, in the prior 12 months. Evergreen is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the website. Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under Washington law. This limitation applies to the website only and does not modify the terms of any signed project agreement.
11. Governing law and disputes
These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules. Any dispute relating to these Terms or your use of the website will be brought exclusively in the state or federal courts located in Spokane County, Washington, and you consent to the jurisdiction of those courts. If any provision of these Terms is found unenforceable, the remaining provisions continue in effect.
12. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the current version. Material changes will be flagged on this page. Continued use of the website after an update means you accept the revised Terms.
